About the Prevention of Cruelty to Animals Regulation
The Prevention of Cruelty to Animals Regulation 2012 (NSW) will automatically repeal on February 1, 2025. The NSW Government is now seeking public feedback on the draft Regulation, which will provide the regulatory framework for animal welfare in NSW.
While the draft includes some changes, such as implementing aspects of the Poultry Standards and Guidelines and revising circumstances for certain procedures on animals, these changes fall short of modern animal welfare science and community expectations.

Why is this important?
The draft Prevention of Cruelty to Animals Regulation 2025 represents a critical opportunity to improve animal welfare protections in NSW, with the current regulations set to automatically repeal on February 1, 2025.
The NSW Government's own Regulatory Impact Statement reveals major problems with the current system, including a flawed enforcement model that relies too heavily on charitable organisations and maintains insufficient penalties that fail to deter violations.
The draft Regulation also maintains concerning exemptions from provisions for rodeos and transportation, effectively allowing practices that would otherwise be considered cruel under the Act - a clear example of how industry interests continue to be prioritised over animal welfare.
